Zoosk Success Story Terms

By using the Zoosk, Inc. (“Zoosk”) Success Stories site in any way, or by submitting your own Success Story, you acknowledge that your use or submission is governed by these Zoosk Success Story Terms, as well as Zoosk’s Terms of Use Agreement at https://www.zoosk.com/tos.php.

1. Users of the Zoosk Success Stories Site

Couples who met on Zoosk can use the Success Stories site to share their dating success story and photos. A success story submitter must be a registered Zoosk member.

The Success Stories site and/or any advertising or promotional materials using your Success Stories are publicly available. Couples who submit content acknowledge that such content may be viewed by the public (including the media). ZOOSK IS COMPLETELY RELEASED OF ALL LIABILITY BY EACH ENTRANT IN THIS SUCCESS STORY TERMS.

2. Submission of Success Stories and Photos

By submitting your success story and/or participating in Success Story-related activities such as a photo shoot you agree and represent that (a) Zoosk may use all, part or none of your content, (b) both members of the couple have agreed to these Terms, (c) both members of the couple have agreed to make their story public, (d) all information and materials submitted are true and accurate, (e) the submission does not conflict with any obligation or restriction you or the other member of the couple may have, (f) the couple met on Zoosk, and (g) both members of the couple are registered Zoosk members. By submitting your success story and/or participating in Success Story-related activities such as a photo shoot you automatically grant, and you represent and warrant that you have the right to grant, to Zoosk, its affiliates, licensees and successors an irrevocable, perpetual, non-exclusive, fully paid, royalty-free, worldwide right and license to use, copy, publicly perform, publicly display, reproduce, adapt, modify and distribute such Success Story and/or related materials including, but not limited to, pictures, ideas and/or communications from a photo shoot and to prepare derivative works of, or incorporate into other works, such Success Story, and to grant and authorize sublicenses of the foregoing in any medium.

3. Zoosk’s Use of Your Success Story

By submitting your success story and/or participating in Success Story-related activities such as a photo shoot, each member of the couple gives Zoosk the unlimited right and permission to use your Success Story and/or related materials such as pictures, ideas and/or communications from a photo shoot, or any parts thereof, including without limitation, (i) on the Success Stories site, (ii) elsewhere on Zoosk’s sites and services (including on Zoosk’s Facebook fan page, YouTube page and any other similar sites) and (iii) in advertising or promotional materials for Zoosk’s products or services. Additionally Zoosk may transfer Your Success Story and/or parts thereof, e.g., related materials such as pictures from a photo shoot, ideas and/or communications as necessary to the effect of the uses described in (i), (ii) or (iii) of this section. Zoosk may use your Success Story and/or related materials such as pictures from a photo shoot in perpetuity, but is not required to use it, or any part of it. Content submitted to the Success Stories site and posted by Zoosk will remain available on the Success Stories site until Zoosk removes such content or discontinues the Success Stories site. Zoosk reserves the right to discontinue the Success Stories site and/or related materials such as pictures from a photo shoot, or any parts thereof, at any time. Zoosk may make changes to your Success Story and/or related materials such as pictures from a photo shoot, ideas and/or communications or any parts thereof. You won’t be entitled to any further compensation of any kind related to your Success Stories, any related materials or their use by Zoosk in accordance with these Zoosk Success Story Terms.
